Terms of Service

1. Acceptance of Terms

By accessing or using FaciliFleet ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

FaciliFleet is a cloud-based fleet and facility management platform that provides tools for vehicle tracking, fuel logging, maintenance scheduling, driver management, trip reporting, work orders, and analytics. The Service is provided "as is" and subject to these terms.

3. User Accounts

• You must be invited by an authorized organization administrator to join the platform. • You are responsible for maintaining the confidentiality of your account credentials. • You agree to notify us immediately of any unauthorized use of your account. • You may not share your login credentials with others. • Accounts are non-transferable.

4. Acceptable Use

You agree NOT to: • Use the Service for any unlawful purpose or in violation of applicable regulations • Submit false, inaccurate, or misleading data (including fuel logs, inspection reports, or trip records) • Attempt to gain unauthorized access to any portion of the Service • Interfere with or disrupt the integrity or performance of the platform • Reverse engineer, decompile, or attempt to extract the source code

5. Data Ownership

Your organization retains ownership of all data entered into the platform. FaciliFleet acts as a data processor on behalf of your organization. We do not claim intellectual property rights over your data.

6. Subscription & Billing

• Plans are billed on a monthly or annual basis as selected at signup. • Subscription fees are non-refundable except where required by law. • Failure to pay may result in suspension of your organization's account. • Plan limits (users, vehicles, assets) are enforced as described in your subscription tier.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. Planned maintenance windows will be communicated in advance. We are not liable for damages resulting from service interruptions.

8. Termination

Either party may terminate the service agreement at any time. Upon termination, your organization's data will be retained for 30 days for export purposes, then permanently deleted. Termination does not relieve obligations for unpaid fees.

9. Limitation of Liability

To the fullest extent permitted by law, FaciliFleet shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by your organization in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Republic of Rwanda. Any disputes shall be resolved in the courts of Kigali, Rwanda, unless otherwise agreed in writing.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use constitutes acceptance.
